1. Acceptance of Terms

Welcome to Safari Academy Online Examination Management System ("OEMS", "Platform", "we", "us", "our"). By accessing or using our platform, website, mobile application, or examination services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an educational institution or organization, you represent that you have authority to bind that entity. If you do not agree to all of these Terms, you must not access or use the Services.

Binding Agreement: These Terms constitute a legally binding agreement between you ("User", "Student", "Examinee") and Safari Academy OEMS.

2. User Accounts & Registration

To access examination features, you must register for a valid account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security and confidentiality of your login credentials.
  • Notify us immediately of any unauthorized account access.
  • Accept responsibility for all activities under your account.

Each student account is non-transferable and intended for individual use only. Sharing login credentials with others is strictly prohibited and may result in permanent account suspension and disqualification of exam results.

Important: Safari Academy reserves the right to verify student identities via government ID, biometric verification, or live proctoring before, during, or after examinations.

3. Examination Conduct & Rules

When taking an online examination through OEMS, you agree to the following rules:

  • Time Limits: Each exam has a designated duration. Submissions after the timer expires may be automatically rejected or penalized.
  • No External Assistance: You may not consult books, notes, websites, or any other individual during an exam unless explicitly permitted.
  • Technical Requirements: You are responsible for a stable internet connection, functional device, and compatible browser. We are not liable for technical failures on your end.
  • Navigation Restrictions: Switching tabs, opening new windows, or using unauthorized keyboard shortcuts may trigger integrity alerts and lead to exam termination.
  • Proctoring Consent: Some exams use AI or live proctoring. By registering, you consent to audio/video monitoring, screen recording, and environment scanning where notified.

4. Academic Integrity & Cheating Policy

Safari Academy OEMS maintains zero tolerance for cheating, plagiarism, or any form of academic dishonesty. Prohibited behaviors include but are not limited to:

  • Copying answers from another person or source.
  • Using artificial intelligence (ChatGPT, Gemini, etc.) to generate answers unless explicitly allowed.
  • Sharing exam questions or answers before, during, or after the exam period.
  • Attempting to hack, reverse-engineer, or manipulate the exam interface.
  • Using virtual machines, VPNs, or remote desktop software to conceal activity.
Integrity Investigations: We employ automated plagiarism detection and manual review. If cheating is confirmed, your exam score will be voided, your account may be suspended, and your educational institution will be notified.

5. User Obligations & Prohibited Activities

You agree NOT to:

  • Upload malicious code, viruses, or any material that disrupts the platform.
  • Attempt to gain unauthorized access to any system, user data, or exam content.
  • Use automated scripts, bots, or scraping tools to interact with the platform.
  • Misrepresent your identity or affiliation.
  • Interfere with other users' exam experience or submit false reports.
  • Record, screenshot, or redistribute exam materials without written permission.

Violations may result in immediate termination of access and legal action where applicable.

6. Intellectual Property Rights

All content on the Safari Academy OEMS platform — including but not limited to exam questions, answer keys, software code, design elements, logos, trademarks, course materials, and reports — is the exclusive property of Safari Academy or its licensors. You are granted a limited, non-exclusive, revocable license to access and use the platform for personal educational purposes only. You may not reproduce, distribute, modify, create derivative works, or publicly display any content without prior written consent.

Any unauthorized reproduction of exam content will be pursued to the fullest extent of copyright and intellectual property laws.

7. Fees & Payment Terms

Some examinations, certifications, or premium features may require payment of fees. All fees are displayed in Ethiopian Birr (ETB) or applicable currency and are non-refundable except as required by law. Payment must be made via approved methods (credit/debit card, bank transfer, mobile money).

  • Registration Fees: Paid at enrollment; non-refundable after exam access granted.
  • Rescheduling: A fee may apply for changing exam dates less than 48 hours before scheduled time.
  • Refunds: No refunds for results, grades, or performance outcomes. Technical issues on our side may be reviewed case-by-case.

We reserve the right to modify fees at any time with 30 days' notice posted on the platform.

8. Termination & Suspension

We may suspend or terminate your account and access to the Services immediately, without prior notice, for conduct that violates these Terms, poses a security risk, or disrupts other users. Upon termination:

  • Your right to use the platform ceases immediately.
  • We may delete your data as per our Privacy Policy.
  • Any pending exam results may be voided.

You may terminate your account at any time by contacting support. However, exam records may be retained for legal/educational requirements.

9. Disclaimers

"AS IS" and "AS AVAILABLE" Disclaimer: The Services are provided without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses. Safari Academy OEMS does not guarantee specific exam outcomes, grades, or academic success. Any reliance on the platform is at your own risk.

We are not responsible for:

  • Internet outages, device failures, or power interruptions.
  • Loss of data due to technical malfunctions beyond our control.
  • Third-party content, links, or services accessed through our platform.

10. Limitation of Liability

To the maximum extent permitted by law, Safari Academy OEMS, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, reputation, or exam opportunities arising from your use of or inability to use the Services. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid to us (if any) in the preceding 12 months, or $50 USD, whichever is less.

Some jurisdictions do not allow certain liability exclusions; in such cases, liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Safari Academy OEMS, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms.
  • Your misuse of the platform or exam content.
  • Any unauthorized activity conducted through your account.
  • Your violation of applicable laws or third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Addis Ababa, Ethiopia, in accordance with the rules of the Ethiopian Arbitration and Conciliation Center. The arbitration decision shall be final and binding, and judgment may be entered in any court having jurisdiction. Each party shall bear its own arbitration costs.

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights.

14. Modifications to Terms

We reserve the right to revise these Terms at any time. Material changes will be notified via email or dashboard notification at least 14 days before they become effective. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use and cancel your account.

By registering or using Safari Academy Online Examination System, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
